  1. Agreement - Terms

All access of any area of the Site is governed by the terms and conditions below ("Terms"). If you do not accept any of these Terms, exit immediately. Continue only if you accept these Terms.

In these Terms, the following words shall have the meaning assigned to them except where the context otherwise requires:

"we", "our" and "us" refers to the HDB

"HDB" refers to the Housing and Development Board

"you" and "User" include the person who is currently accessing the Site

“Site” includes this site and any other site currently being accessed by the User and any site link to or from the Site and include any HDB eServices

2. User’s Responsibility

(i) must not use the Site for any unlawful purpose,

(ii) is fully responsible for all transactions and/or enquiries made through the use of his/her identification, regardless of whether such transactions or enquiries were made with or without the User’s knowledge and authority, and

Where information is provided in the Site, it is meant as a general information source only and we are not involved in giving professional advice here. The Site may not cover all information available on a particular issue.

3. Privacy & Security

Subject to the terms of our Privacy Policy in the HDB InfoWEB, HDB will not disclose any personal information obtained from the User unless otherwise required by law.

Where appropriate, we will use available technology to protect the security of communications made through the Site.

Internet communications may be susceptible to interference or interception by third parties. Despite our best efforts, we make no warranties that the Site is free of infection by computer viruses or other unauthorised software.

You should take appropriate steps to keep your information, software and equipment secure.

This includes clearing your Internet browser cookies and cache before and after using any services on the Site.

4. Intellectual Property

Materials, including source code, pages, documents and online graphics, audio and video in the Site are protected by law. The intellectual property rights in the materials are owned by or licensed to us. All rights are reserved.

No part of the Site may be reproduced or reused for commercial or any other purposes whatsoever without our prior written permission.

5. General Disclaimer And Limitation Of Liability

HDB makes no warranty that the Site will meet the User’s needs or requirements, or that any service, software or information provided will be uninterrupted, timely, accurate, reliable, secure or error free.

Information and materials contained in the Site are provided on an “as is” and “as available” basis. HDB does not warrant the accuracy, adequacy, timeliness or completeness of such information or materials and expressly disclaims any liability for errors or omissions.

The User acknowledges, accepts and assumes all risks inherent in Internet transactions and will not hold HDB liable under any circumstances whatsoever for any claim or demand (for damages, losses, expenses or otherwise) which the User may have or be exposed to as a result of the User assuming such risks.

We will not be liable for any loss or damage

(i) that you may incur on account of using the Site, and/or using, visiting or relying on any statements, opinion, representation or information in the Site,

(ii) resulting from any delay in operation or transmission, communications failure, Internet access difficulties or malfunctions in equipment or software, or

(iii) for the conduct or the views of any person who accesses or uses your email account to access the Site.

6. Access To The Site

The accessibility and operation of the Site relies on technologies outside our control. We do not guarantee continuous accessibility or uninterrupted operation of the Site at any time including when you may be accessing any information or performing online transactions/services.

7. Hyperlinks

We are not responsible or liable for the availability or content of any other Internet site (whether or not provided by us) linked to or from the Site. Access to any other Internet site is at your own risk. If you create a link, frame or otherwise whatsoever to or from the Site, you do so at your own risk.

For any Internet sites including your sites (if any) which want to create a link, frame or otherwise whatsoever to or from the Site, they must obtain prior written permission from us. We reserve the right to impose conditions including imposing a fee when granting such permission.

We reserve the right to object or disable any link, frame or otherwise whatsoever to or from the Site.

We reserve the right to change any URL including the URL of the Site without notification.

8. Fees

We reserve the right to introduce and revise any fees from time to time. We are not responsible for any fees charged by any other Internet site (not provided by us).

9. Indemnity

You shall at all times indemnify, keep indemnified and hold harmless HDB against all losses (including direct, indirect, incidental and/or consequential losses), damages (including general, special and/or punitive damages), injuries, claims, costs, fees (including all legal fees as between solicitor and client or otherwise on a full indemnity basis whether or not incurred in respect of any real, anticipated or threatened legal proceedings), howsoever caused by, arising or resulting from any use by or through you of the Site and/or any breach or purported breach of these Terms and/or any applicable law, whether or not written.

10. Applicable Laws

Use of the Site, and these Terms are governed by the laws of Singapore. Any claim relating to use of the Site, and these Terms shall be heard by Singapore Courts.

11. Variation

We may revise these Terms and/or modify or discontinue any information or features that form part of the Site at any time, with or without notice to you, and without liability. You must visit these Terms every time when accessing the Site and review the then current Terms because they are binding on you. If you do not agree to any amendments to these Terms, you must not proceed but exit immediately.

12. Notices

Notices to the User may be given either through e-mail or other
means, including:
(i) telephone,
(ii) teletex,
(iii) facsimile,
(iv) normal mail,
(v) registered mail,
(vi) by hand,
(vii) sms messages, or
(viii) through WAP-enabled facilities.

13. Terms and Conditions for HDB eServices

In addition to these Terms, the User shall also be required to comply with all other terms and conditions of the respective HDB eServices when using the same.

In the event of conflict, the terms and conditions of the respective HDB eServices shall prevail.
